Interference with the Rights of Guardian of the Person
Chapter 25 of the Texas Penal Code places restrictions and guidelines on offenses dealing with the family.
“Interference with the Rights of Guardian of the Person”, as per § 25.10 of the Texas Penal Code, occurs when a person takes, retains, or conceals a ward when the person knows that the person's taking, retention, or concealment interferes with a possessory right with respect to the ward.
An offense under this section is a state jail felony.
Punishment Range
State Jail Felony
- Confinement in a state jail for not more than two years and not less than 180 days
- In addition to confinement, may receive a fine not to exceed $10,000
