Manufacture, Possession, or Delivery of Unlawful Telecommunications Device
Chapter 33a of the Texas Penal Code defines telecommunication related offenses.
“Manufacture, Possession, or Delivery of Unlawful Telecommunications Device”, as per § 33a.03 of the Texas Penal Code, occurs when a person manufactures, possesses, delivers, offers to deliver, or advertises:
- a counterfeit telecommunications device; or
- a telecommunications device that is intended to be used to commit an offense under Section 33A.04 or conceal the existence or place of origin or destination of a telecommunications service.
A person commits an offense if the person delivers, offers to deliver, or advertises plans, instructions, or materials for manufacture of a counterfeit telecommunications device or a telecommunications device that is intended to be used to commit an offense.
An offense under this section is a third degree felony.
Punishment Range
Third Degree Felony
- Imprisonment in the institutional division for not more than 10 years or less than two years
- In addition to imprisonment, may receive a fine not to exceed $10,000
