Obstruction or Retaliation
Chapter 36 of the Texas Penal Code defines bribery and corrupt influence offenses.
“Obstruction or Retaliation”, as per § 36.06 of the Texas Penal Code, occurs when a person intentionally or knowingly harms or threatens to harm another by an unlawful act:
- in retaliation for or on account of the service or status of another as a:
- public servant, witness, prospective witness, or informant; or
- person who has reported or who the actor knows intends to report the occurrence of a crime; or
- to prevent or delay the service of another as a:
- public servant, witness, prospective witness, or informant; or
- person who has reported or who the actor knows intends to report the occurrence of a crime.
An offense under this section is a third degree felony.
Punishment Range
Third Degree Felony
- Imprisonment in the institutional division for not more than 10 years or less than two years
- In addition to imprisonment, may receive a fine not to exceed $10,000
