Offering Gift to Public Servant

Chapter 36 of the Texas Penal Code defines bribery and corrupt influence offenses.

“Offering Gift to Public Servant”, as per § 36.09 of the Texas Penal Code, occurs when a person offers, confers, or agrees to confer any benefit on a public servant that he knows the public servant is prohibited by law from accepting.

An offense under this section is a Class A misdemeanor.

Punishment Range

Misdemeanor A

Confinement in jail for a term not to exceed one year
Fine not to exceed $4,000
Both such fine and confinement
